Sample Illinois Question
Without a client waiver, which scope and timing must a licensee use when presenting offers to and from the client?
- AEvery offer promptly.
- BOnly full-price offers promptly.
- COnly solicited offers promptly.
- DEvery offer at closing.
Show answer and explanation
The correct answer is A. This question asks about both the scope and timing of presentation when the client has not waived the duty. In Illinois, all offers to and from the client must be presented promptly, with an exception when the client waives this duty. The requirement to present all offers prevents price or solicitation from being used to narrow what is presented. Promptness is a separate timing requirement and must be checked independently of whether every offer is included. The rule protects the client's opportunity to evaluate proposals instead of having the licensee select them. Filtering offers or waiting until closing can limit that opportunity. Here, there is no client waiver, so every incoming and outgoing offer must be presented promptly. B: Presenting only full-price offers restricts the scope by price. The rule requires presentation of every offer regardless of price. C: Presenting only solicited offers restricts the scope by solicitation. The rule does not distinguish offers according to whether they were solicited. D: Presenting every offer at closing does not satisfy the promptness requirement. Getting the scope right alone does not fulfill the presentation duty.
Exam tip
For offer-presentation questions, check the scope of all offers separately from the timing requirement of promptness. Without a client waiver, offers coming to and going from the client are both covered. Distinguish full-price offers from all offers, and do not use solicitation to narrow what must be presented. Even when every offer is included, check whether presentation waits until closing. A broad scope does not by itself satisfy the timing requirement. First identify whether the client waived the duty, then apply both the scope and timing requirements.
